Spain scraps the national rental registry: what it means for Costa del Sol owners
On 22 May 2026, Spain's Supreme Court (Tribunal Supremo) struck down the national rental registry - the same NRA number that had been mandatory on every Airbnb and Booking listing since 1 July 2025. Owners across the Costa del Sol are now asking: do I still need that number, and am I still renting legally? What happened on 22 May 2026?
The Tribunal Supremo (Spain's highest court) declared the national rental registry invalid. That registry - created by Royal Decree 1312/2024 and mandatory since 1 July 2025 - assigned every rental property a unique registration number (the NRA) that platforms like Airbnb and Booking.com were required to display.
The court ruled that the central government in Madrid had overstepped its authority: tourism and housing are primarily the competence of the autonomous regions (such as Andalusia), not the national government. The national registry overlapped with existing regional registries and was therefore unlawful.
Note: this is a developing story. The national government may appeal or draft new legislation. Always confirm the current position with the Junta de Andalucía or a Spanish gestor before acting.
What exactly was voided - and why?
Only the national registration number (NRA/NRUA) from RD 1312/2024 was struck down. The court's reasoning, in brief:
• Competence - regulating tourist housing is a regional power; Madrid could not impose an overlapping national registry
• No EU requirement - the court stressed that EU Regulation 2024/1028 does NOT require a centralised national registry; member states may organise this regionally
• Double administration - owners had to register both regionally (VFT) and nationally (NRA) for the same property
What was NOT struck down: the "single digital window" for data exchange between platforms and authorities survived. Airbnb and Booking.com must therefore continue sharing rental data with the government.
What still applies to you in Andalusia?

What should you do now?
A practical checklist for Costa del Sol owners:
- Stop applying for a new NRA number - a pending application is no longer needed. Already have an NRA number on your listing? Leave it for now; removing it can wait and it does no harm.
- Check your VFT registration - this is your most important licence. Is it in your name, with the correct room and guest count? Update it if anything has changed.
- Keep registering guests via SES Hospedajes - this does not change. The fines (€600 to €30,000) remain real and cross-checks against platform data continue.
- Watch platform communications - Airbnb and Booking may adjust their registration-number field. Don't react impulsively; wait for their official guidance.
